
Supreme Court of Cassation in Belgrade has annulled a decision of Serbia's Commission for Protection of Competition, by which the Commission ordered dairy companies Imlek and Mlekara Subotica to pay a fine because of an earlier determined alleged abuse of their dominant position in the raw milk market, Danube Foods Group, the owner of these dairy companies, said in a release today.
In that way, these dairy companies will get back EUR 3 million they have paid for the fine, plus the interests, reads the release.
Considering all legal arguments that, among the rest, dispute the legality of the initial ruling by the Administrative Court and its legal grounds, the explanation of the ruling by the Supreme Court of Cassation says that neither is there a res judicata, nor was it determined in the administrative procedure that aforementioned companies had abused their dominant position in the market.
